Dean McDermott facing jail for nonpayment of child support

Texas parents who have divorced may be interested to learn the Dean McDermott, Tori Spelling's husband, was required to pay a certain amount in child support to his first wife by March 13. If he does not, he could potentially be facing a jail sentence.

McDermott reportedly stopped paying child support to his ex-wife for his 18-year-old son in October after he claimed that he had fallen on hard times. He reportedly owes thousands in back child support and has face eight counts of contempt, one for each payment he has missed. Prior to this incident, the charges had all been dismissed.

In a hearing that was held in a Los Angeles court, the judge gave McDermott the ability to work out an agreement with his ex-wife. He was required to pay the ex-wife half of the amount of back child support that he owed. If he does not pay, the ex-wife could re-file the complaint. If this does occur, it is a possibility that he could be sentenced to jail for nonpayment.

Because raising children can be difficult on one income, a non-custodial parent may be ordered to pay child support as part of a divorce decree. However, a change in financial circumstances could cause a parent to be unable to pay the amount that is owed. A family law attorney may help the parent request a modification to the child support order. The attorney may provide the judge with the parent's financial paperwork to show that the parent no longer makes enough to make the payments.
